Crib Bumper Pad Restrictions Introduced in New York State, USA

New York State enacts a ban on the sale of crib bumper pads and restricts their use in certain public settings.

New York State has enacted a new law that prohibits the sale of crib bumper pads, effective October 12, 2019.

Signed into law on August 13, 2019 by Governor Andrew M. Cuomo, Senate Bill S03788 also prohibits the following places from using, or having on the premises, crib bumpers:
• Childcare facilities
• Places of public accommodation

Crib bumper pads may still be used if a medical professional has determined it is medically necessary for the child.

Under the terms of the law, crib bumper is defined as:
“A pad or pads of a non-mesh material resting directly above the mattress in a crib, running the surface area of the crib or along the length of any of the interior sides of the crib. "Crib bumper pad" does not include mesh liners.”

New York State is just the most recent US jurisdiction to ban the sale of crib bumper pads. Maryland and Ohio states, including the city of Chicago and the borough of Watchung, and New Jersey all have similar laws. Stakeholders should also be aware that a bill to prohibit manufacturers from selling, offering for sale, distributing in commerce, or importing into the US any crib bumper, was introduced to the US Congress in June 2019.
